Online Banking Agreement
This Online Banking and Bill Pay Agreement is between Liberty Bank Minnesota, 111 7th Avenue South, St Cloud, MN 56301 providing your Online Banking and Bill Pay Services and each consumer who has enrolled in this Online Banking and Bill Pay Service including anyone authorized by the consumer to use the consumer’s Online Banking and Bill Pay Service.
1. Setting up and using Online Banking and Bill Pay Services
To use Liberty Bank Minnesota Online Banking and Bill Pay Services, you must have at least one eligible account with Liberty Bank Minnesota. We consider eligible accounts to be checking accounts, savings accounts, money market accounts, CD’s, IRA’s, Consumer Loans, Home Equity Loans and Mortgage Loans. Only checking accounts with Liberty Bank Minnesota are eligible for Bill Pay Services. This “Agreement” is subject to other agreements between you and us including but not limited to deposit account agreements and funds availability policies.
You can access all Accounts at the Bank held in your name and held jointly with others through the Online Banking and Bill Pay Services. Liberty Bank Minnesota reserves the right to limit the types of deposit and loan Accounts that are available for Online Banking and Bill Pay Services.
You must designate a User ID and password to use Online Banking and Bill Pay Services. Both your User ID and password are case sensitive. Your User ID must be a minimum of eight characters and a maximum of thirty-two characters and contain at lease two alpha and two numeric characters. Your password must be a minimum of six (6) characters and a maximum of thirty-two (32) characters and contain at least one alpha and one numeric character.
To help enhance your security, we recommend that you follow some general safety guidelines:
- Never walk away from your computer while logged on to this service
- Memorize your User ID and Passwords instead of writing them down
- DO NOT share your codes with anyone
- Choose codes that are not easy to guess
We may modify, suspend, or terminate access to the Online Banking and Bill Pay Services at any time and for any reason without notice. Liberty Bank Minnesota reserves the right to require you to periodically change your User ID and/or Password.
2. Business Hours/System Access
Online Banking and Bill Pay Services are typically available 24 hours a day, seven days a week, except for circumstances in which Online Banking and Bill Pay Services may be inaccessible for a reasonable period of time for scheduled maintenance or emergency system maintenance. We will make every effort to notify you in advance when Online Banking and Bill Pay Services are not available.
Business Days for Online Banking and Bill Pay Services are Monday through Friday.
You can make transfers between eligible accounts until 7:00 p.m. CT on any Business Day. Transfers made after 7:00 p.m. will be credited for the next business day. For bill payments, you may add, delete or edit a Bill Payment until 7:00 p.m. CT on the payment date. A recurring payment may be added, deleted, or edited by 7:00 p.m. CT at least 1 day prior to the payment date. (Keep in mind when modifying a recurring payment, you are affecting all future payments associated with that payment or transfer.)
You must obtain, install, and maintain the necessary software, hardware and internet access services needed to perform Online Banking and Bill Pay Services. Liberty Bank Minnesota will not be responsible for inability to access the system from the malfunction or failure of your hardware, software, or internet Access Services. You will be responsible for the setup and maintenance of your computer. We will require that your browser be 128-bit encryption enabled.
3. Types of Services Available
Online Banking: You may use Online Banking to perform unlimited funds transfers between eligible accounts (please refer to your account agreement for transaction limitations and fees.) You can check the balances on eligible accounts along with other detailed account information, you can place stop payments on checks, access images of checks and bank statements using Online Banking.
Bill Pay Services: You can make single payments or schedule recurring payments to occur automatically on an ongoing basis.
4. Detail of Bill Pay Services
You will choose an account to designate as the account used to make bill payments. On the date you request the bill payment, the funds will be deducted out of your account within 2 days of the payment being requested. When you are scheduling payments, please allow 3 business days on electronic payments and 5 business days for standard check payments to be received to ensure payments are received on time.
Liberty Bank Minnesota is not able to determine the date in which the party you are issuing the bill payment to will credit the payment to your account since this is based on their processing payment procedures.
You authorize us to make payments by electronic, paper or other means we determine appropriate.
You are responsible for having sufficient available funds on deposit to make payments in full on scheduled dates.
If applicable you agree to pay all and any fees related to the use of Online Banking and Bill Pay Services.
After you have enrolled, you can withdraw your enrollment or future consent to future electronic documents by calling 1-888-850-2265 or sending an email to firstname.lastname@example.org. We reserve the right to terminate in whole or in part your access to Online Banking or Bill Pay Services.
7. Change in Terms
We may amend, add, delete or change terms, conditions and other provisions, fees, charges, or other terms described in this Agreement.
Any changes to this Agreement will be posted on our website and will be provided to you when required by law.
You are bound by such change if you use the service after the effective date of the notice unless you notify us, before the effective date of the change/amendment, that you reject these changes and cancel your Liberty Bank Minnesota Online Banking and Bill Pay Service or close your Accounts (if applicable).
Liberty Bank Minnesota will make all efforts to complete your bill payments and transfers properly. Liberty Bank Minnesota cannot be held liable if we are unable to complete a payment or transfer for the following reasons:
- The funds in your account are not available for the following reasons; a legal hold has been placed on your account or you do not have sufficient funds in your account or you have exceeded the available credit limit on the line of credit that is attached to your checking account.
- You have given us an incorrect name, address or account number of the payee in which you are asking us to complete a bill payment for.
- The payee in which the bill payment is issued to does not properly handle the application of the payment or delays the application of the payment.
- The service is not properly working or there is a communication failure or circumstances beyond our control including a natural disaster such including but not limited to a flood or a fire, or a outside altercation.
- We have revoked your access to this service.
You will be liable for any unauthorized transactions on your account. You should not disclose your codes to any other person, they are confidential to you and should be used for your purposes only. Contact us immediately if you feel that someone has obtained this information and could access your accounts. The best way to minimize your losses is to contact us immediately under these circumstances. When you receive your bank statement, if you determine that there is a transaction that was not authorized by you, please notify us immediately. You have 60 days from the date of the first statement in which the error or problem appeared to notify us of this.
NEITHER WE NOR ANY INFORMATION PROVIDERS MAKE ANY WARRANTY, EXPRESS OR IMPLIED, TO YOU CONCERNING THE EQUIPMENT, BROWSER OR OTHER SERVICES INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE OR NON-INFRINGEMENT OF THIRD PARTY RIGHTS, UNLESS DISCLAIMING SUCH WARRANTY IS PROHIBITED BY LAW. THESE SERVICES AND RELATED DOCUMENTS ARE PROVIDED AS IS.
10. Consumer Privacy and Policy
It is Liberty Bank Minnesota’s highest priority is to maintain the privacy and confidentiality of our customers information. Please refer to our website at http://www.libertybankmn.com/privacy-security.php to review this statement.
This Agreement represents our complete agreement with you relating to our provision of the Banking Services. No other statement, oral or written, including language contained in our website, unless otherwise noted, is part of this Agreement.
